Content Removal Policy (DMCA)
Ardinas.pt respects the intellectual property rights of third parties and expects users of our forum to do the same. This page explains the procedure to follow if you consider that any content published on our forum violates your copyright, under the terms of Digital Millennium Copyright Act (DMCA) and applicable Portuguese legislation on copyright and related rights.
1. Copyright Notice
Our forum allows users to post comments, images, links and other content. Ardinas.pt does not previously check all content submitted by users and is not responsible for its legality. However, we undertake to quickly remove any content that violates third-party copyrights, upon valid notification.
2. How to Submit a Takedown Notice
If you are a copyright holder (or authorized representative) and you believe that content available on our forum infringes your rights, you must send us a written notification that includes the following information:
- Identification of the copyrighted work claimed to have been infringed;
- The exact URL (page address) where the allegedly infringing content is located;
- Your full name, postal address, telephone number and email address;
- A statement that you have a good faith belief that use of the content is not authorized by the rights owner, its agent, or the law;
- A statement that the information provided in the notification is accurate, and under penalty of perjury, that you are the rights owner or authorized to act on its behalf;
- Your physical or electronic signature.
3. Where to Send the Notification
Takedown notifications must be sent to the following email address:
Notifications that are incomplete or do not meet the above requirements may not be processed.
4. Counter-Notification Process
If content you posted was removed following a copyright notice and you believe that such removal was the result of error or misidentification, you may submit a counter-notice that includes:
- Identification of the content that was removed and its previous location;
- A statement, under penalty of perjury, that you have a good faith belief that the content was removed due to mistake or misidentification;
- Your full name, postal address, telephone number and email address;
- A statement that you submit to the jurisdiction of the competent court and that you will accept service of process from the party who submitted the original notification;
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we may restore the removed content, unless the original complainant initiates legal action in this regard within the legally prescribed period.
5. Repeat Infringer Policy
Ardinas.pt reserves the right to suspend or close the accounts of users who are repeat offenders in publishing content that violates the copyright of third parties.
